This paper examines the lawsuits brought by state and local government entities against prescription opioid producers and sellers. It examines their potential liability as well as some of the defenses they might raise. The paper also discusses multidistrict litigation and government lawsuits in state court. It concludes that litigation is not the best solution to the opioid crisis.

In Protestant theology, the law of the Old Testament still has two functions for Christians: as God’s containment of the chaos in the form of political order and as confronting self-righteous humans in their inability to comply and pointing them to the necessity of grace. For Reformed Protestants however, there is a third use of the law, directed to the renatus, the ‘born again’ Christian, to the iustus and not to the peccator in order for him to keep growing in (...) insight and the practice of God’s will. Different from the Lutheran usus politicus, it is not limited to being God’s containment of evil through the orders of creation, but the realisation of and the public responsibility for those possibilities of life that were disclosed for men/women as partners in God’s covenant by God’s law. Croatia is a transitional society in that it is a country emerging from a socialist command economy toward a market-based economy with ensuing structural changes of a social and political nature—some extending into the healthcare system. A legacy from our past is that, until now, Croatian healthcare institutions have had no real experience with clinical ethics support services. When clinical cases arise presenting complex ethical dilemmas in treatment options, the challenges presented to the medical team are substantial. The case described (...) below recently occurred on a ward in a university hospital in Croatia. An unexpected request from the patient’s parents created a number of issues that needed to be addressed by the medical team, which was made more difficult by the lack of clinical ethics support services. Such cases press the question currently being debated as to what type of ethics support services would be suitable for Croatia and why. (shrink)

El objetivo de este trabajo es mostrar la influencia socrática sobre la filosofía de Euclides de Mégara, en contra de la interpretación que señala la influencia de los eleáticos sobre su teoría. Para ello indicaré que la doctrina de Euclides exhibe una fuerte impronta socrática, al menos en lo que concierne a: su labor como escritor de diálogos socráticos, el uso de la dialéctica erística, el desarrollo de algunos postulados éticos sobre la conducta frente a la muerte, el auto-dominio y (...) la unidad de la virtud, y la presentación de una metafísica que coloca al bien en un lugar privilegiado. Aunque esta metafísica excede el socratismo, no puede ser identificada con los postulados de la filosofía eleática. (shrink)

A selection from the correspondence of the logician Wilhelm Ackermann (1896?1962) is presented in this article. The most significant letters were exchanged with Bernays, Scholz and Lorenzen, from which extensive passages are transcribed. Some remarks from other letters, with quotations, are also included.

This personal letter describes the history and current situation of philosophy in Estonia. We sketch the development of academic philosophy since the foundation of Tartu University in 1632, and describe the current philosophical landscape. We discuss the challenges we are facing in trying to find a balance between the responsibility that a discipline in the humanties in a small country has with respect to local culture and society on the one hand, and our ambitions to build up an internationally collaborating (...) department with an international graduate programme on the other. We close with a description of the relation between academic philosophy and Estonian society and the role that the Center for Ethics in Tartu plays in supporting that relation. (shrink)

Wendet man sich der Frage nach den Quellen unseres Wissens zu, so muss man feststellen, dass wir zweifelsohne einen großen Teil unseres Wissens über die Welt aus dem Zeugnis anderer gewinnen. In der gegenwärtigen erkenntnistheoretischen Diskussion wird nicht in Frage gestellt, dass das Zeugnis anderer zur Genese unseres Wissens beiträgt. Umstritten ist dagegen,ob die Anführung des Ursprungs solcher Überzeugungen auch zu deren Rechtfertigung in hinreichendem Maße beiträgt. Dieses Buch bietet einen systematischen Einblick in die verschiedenen epistemologischen Positionen dieser Debatte – (...) sowohl klassische Ansätze als auch neuere Entwicklungen werden vorgestellt und kritisch diskutiert. Darüber hinaus wird der Zeugnisbegriff selbst – als epistemisch funktionaler Begriff – eingehend analysiert. Aufbauend auf den Untersuchungsergebnissen des systematischen Teils des Buches wird dann in einer Fallstudie zur Berichterstattung der Tagesschau ein Sonderfall des Zeugnisses anderer genauer in den Blick genommen, der in der bisherigen epistemologischen Debatte erstaunlicherweise nur eine untergeordnete Rolle gespielt hat: die mediale Berichterstattung. ZusammenfassungDie Geschichte der genetischen Pränataldiagnostik ist bislang als Teil der Geschichte der Humangenetik und deren Neuorientierung als klinisch-laborwissenschaftliche Disziplin in der zweiten Hälfte des 20. Jahrhunderts betrachtet worden. Anhand neuen Quellenmaterials soll in diesem Beitrag gezeigt werden, dass das Interesse an der Pränataldiagnostik in Westdeutschland auch im Kontext von Forschungen entstand, die sich mit Gefahren für den Menschen in der Umwelt befassten. Anhand der Debatten um die Einrichtung des DFG-Schwerpunktprogramms „Pränatale Diagnostik genetischer Defekte“ 1970 untersuchen wir, wie die Technik der (...) Amniozentese in Westdeutschland von einer interdisziplinären Forschungsgruppe eingeführt wurde, die sich mit Schädigungen des Organismus durch Strahlen, Arzneimittel und andere Gebrauchsstoffe und Konsumgüter befasste. In einer als ökologische Wende bezeichneten Zeit wachsenden Umweltbewusstseins, so unsere These, sollte durch die Förderung der Pränataldiagnostik eine wahrgenommene Lücke in der Prävention umweltbedingt auftretender genetischer Anomalien geschlossen werden. Für die Pränataldiagnostik als „Schutzmaßnahme“ sprach unter anderem ihre erwartete Finanzierung als Krankenkassenleistung im Zuge der Reform des Abtreibungsrechts. Erst in einem zweiten Schritt führten Veränderungen von Strukturen der Forschung, vor allem aber Erfahrungen in der gynäkologischen Praxis zu einer Neuausrichtung auf die Diagnostik und Prävention mehrheitlich erblicher oder spontan auftretender Anomalien. Die Pränataldiagnostik, so wie sie schließlich in Westdeutschland ab den frühen 1980er Jahren routinemäßig Einsatz fand, hatte mit Fragen der „Umwelt“ kaum noch zu tun. Diese Fallstudie zur Frühgeschichte der genetischen Pränataldiagnostik handelt von dem noch wenig untersuchten Verhältnis von humangenetischer Forschung, klinischer Praxis und Umweltforschung und hat zum weiteren Ziel, den bisher in anderen Kontexten beschriebenen Wandel von Perspektiven in der Vorsorge um 1970 zu beleuchten. This paper is a demonstration of an application of Semiotic Textology to a limited case study. The main aspects of Semiotic Textology, the theory elaborated by Petöfi, are presented; secondly the linguistic aspects of the interpretation of lines 133–134 of the Theognis of Megara’s poem, analysed in the framework of said theory, are presented. All the relevant syntactic, semantic, pragmatic information involved in text processing have been considered. Through fixed steps, it is shown that text processing is not exclusively (...) a grammatical activity, because within a theoretical interpretation an Interpreter needs a number of contextual hypotheses, in order to understand the author’s ontology. Bei der akademischen Feier zu seinem achtzigsten Geburtstag ist der Politikwissenschaftler Kurt Shell gefragt worden, ob er aufgrund seiner großen akademischen Expertise und jahrzehntelangen persönlichen Erfahrung mit dem Niedergang und Wiedererstarken von Demokratien ein Resümee ziehen könne, auf welchen Hauptfaktoren seiner Meinung nach stabile Demokratien beruhen.
